DISPUTES & REPLIES

Notice Invoking Arbitration (Section 21)

Use when a contract with an arbitration clause is in dispute and negotiation has failed. The date the other side receives this notice is the date arbitral proceedings begin, which also matters for limitation. If they do not agree to an arbitrator within 30 days, you can ask the court to appoint one.

How to execute

Sign on your letterhead and send. No stamp paper needed.

Send by Registered Post AD or Speed Post with tracking, and by e-mail. Keep the postal receipt and tracking printout as proof of service. Check the arbitration clause first: follow any required notice period, negotiation step, institution or number of arbitrators exactly. Ask your proposed arbitrator to confirm availability and independence before naming them.
