AUTHORISATIONS & DECLARATIONS

Special Power of Attorney

Use when you cannot attend personally and someone must sign, appear or deal with a defined matter for you, such as one transaction, one registration or one office. Keep the listed acts narrow. A general power over all your affairs is a different and riskier document.

Laws this relies on

  • Powers of Attorney Act, 1882Governs instruments by which one person authorises another to act in their name.
  • Indian Contract Act, 1872 · Section 201Agency ends on revocation, completion of the business, or death, unsoundness of mind or insolvency of the principal.
  • Registration Act, 1908 · Sections 17–18A POA authorising sale or transfer of immovable property usually must be registered under state amendments — check your state.
  • State Stamp ActStamp duty on a POA is fixed by each state and is higher where property is involved.

How to execute

Print on stamp paper, sign, and get it attested by a Notary.

Execute on non-judicial stamp paper (or e-stamp) of the value your state prescribes, sign before a Notary with two witnesses, and attach photographs and ID copies of both parties. If the POA authorises any sale, transfer, mortgage or lease of immovable property, have it registered at the Sub-Registrar's office — many states make this compulsory. Stamp duty and the stamp-paper value vary by state — check your state Stamp Act (or use e-stamping through SHCIL where available) before execution.

This is a general template, not legal advice. Laws, stamp duty and procedures vary by state and change over time — have a qualified advocate review it for your facts before signing or sending.
